Product Reviews, Restaurant Reviews and Recipes: All GLUTEN FREE!
This week (May 2017) the Court of Appeal judges in London crushed Nestle’s attempts to trademark the shape of its four-fingered KitKat bar. They claimed that the shape of the bar was so unique it should be protected by law but it’s case was not helped by a similar Norwegian bar, called Kvikk Lunsj, which means “quick lunch” and has been produced since 1937.
This is part of the ongoing saga between Cadbury & Nestle whom have been facing each other in the UK Courts over many years. Cadbury failed to trademark it’s shade of purple used for Dairy Milk bars after Nestle complained. Nestle has commented “This judgement does not mean that our four finger-shape is now free for use in the UK or elsewhere. KitKat is much loved around the world and its four finger-shape is well-known by consumers. Nestle’s four finger shapes has been granted trademark registration in many countries of the world for instance Germany, France, Australia, South Africa and Canada, further protecting it from imitations.” Interesting that they didn’t name Norway! Of course, Cadbury’s owner Mondelez have also commented on this new development and stated “We are pleased with the Court of Appeal’s decision today and welcome their conclusion. As we have preivoulsy stated, we do not believe the shape of the KitKat bar should be protected as a trade mark in the UK.”
I am still awaiting a GLUTEN FREE KitKat bar so I can enjoy this four-fingered Chocolate Bar.
